The contribution of international intellectual property law to the happiness of Indigenous Peoples
Résumé
L’adoption du Traité de l’OMPI du 24 mai 2024 à Genève sur la propriété intellectuelle, les ressources génétiques et les savoirs traditionnels associés marque un tournant historique dans l’évolution du droit international de la propriété intellectuelle. Cette contribution analyse la manière dont ce traité peut contribuer au bonheur des peuples autochtones, en examinant ses apports normatifs et institutionnels. L’étude révèle que, malgré ses limitations reconnues, le traité constitue une avancée significative dans la reconnaissance des droits des peuples autochtones, établissant des mécanismes de protection défensive contre la biopiraterie et ouvrant la voie vers une conception plus inclusive du bien-être collectif autochtone dans le système international de propriété intellectuelle.

Abstract
The adoption in Geneva on 24 May 2024 of the WIPO Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge marks a historic turning point in the development of international intellectual property law. This article analyses how the Treaty may contribute to the happiness of Indigenous Peoples by examining its normative and institutional innovations. The study shows that, despite its recognised limitations, the Treaty represents a significant step forward in the recognition of Indigenous Peoples’ rights by establishing defensive protection mechanisms against biopiracy and paving the way for a more inclusive understanding of collective Indigenous well-being within the international intellectual property system.
